Terms of Service

These Terms of Service ("Terms") govern your use of mazdek AI and its features (the "Service"), operated by mazdek GmbH ("mazdek", "we", "us"), a company based in Switzerland. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 13 years old (and have the legal capacity to enter into a contract, or your parent/guardian's consent) to use the Service. You are responsible for your account, for keeping your credentials secure, and for all activity that occurs under your account. Provide accurate information and keep it current.

2. The Service & Artificial Intelligence

The Service uses artificial intelligence — including generative and machine-learning models — to provide speech recognition, translation, summarization, text-to-speech, and chat features. You acknowledge that you are interacting with an automated AI system.

AI outputs are generated probabilistically and may be inaccurate, incomplete, outdated, offensive, or otherwise unsuitable. The Service does not provide professional advice (legal, medical, financial, or otherwise). You are solely responsible for reviewing and verifying any output before relying on or acting on it, and for any decision you make based on it.

Because outputs are produced by machine-learning models, the same or similar outputs may be generated for different users; outputs are not guaranteed to be unique.

3. Acceptable Use

You agree not to use the Service to:

• produce, store, or share child sexual abuse material (CSAM) or any content that sexually exploits or endangers minors — we have zero tolerance and report such material to the authorities;
• break any law or regulation, or infringe anyone's rights (including intellectual property, privacy, or publicity rights);
• generate or distribute unlawful, harmful, hateful, harassing, deceptive, or sexually exploitative content;
• harass, bully, threaten, impersonate, or send unsolicited or objectionable content to other users through profiles, discovery, direct messages, or other social features;
• create deepfakes, impersonation, disinformation, or other deceptive media, or clone a person's voice or likeness without their consent;
• attempt to bypass safety measures, "jailbreak", reverse-engineer, scrape, or overload the Service, or use it to build or train a competing model or product;
• upload malware or attempt to gain unauthorized access.

We may investigate and take action — including removing content and suspending or terminating accounts — for suspected violations.

We operate a zero-tolerance policy toward objectionable content and abusive users. Our social features — profiles, discovery, and direct messages — provide tools to block and report other users; we review reports and remove offending content or users where warranted.

Community feed (Civat). The same rules apply to public posts, voice posts, and comments in the community feed. Every post and comment can be reported in-app (including as illegal content under the EU Digital Services Act notice-and-action process); reported content is reviewed within 24 hours and may be hidden or removed while under review. Content that collects multiple reports may be hidden automatically pending review. Repeated or serious violations can lead to account suspension or termination.

4. Your Content

You retain ownership of the content you submit (audio, text, documents, and other inputs) and of the outputs generated for you, to the extent such outputs are protectable. You grant mazdek a worldwide, non-exclusive, royalty-free license to host, process, and transmit your content solely to operate, secure, and improve the Service and to provide it to you.

You are responsible for your content and confirm you have the rights necessary to submit it. Do not upload content you are not permitted to share, or that contains others' personal data without a lawful basis.

Voice & likeness: if you submit voice recordings or create custom voices, you confirm that you own them or are authorized to use them and that you have obtained any consents required from the person whose voice or likeness is involved. We do not commercialize your voice or likeness on a standalone basis without your permission.

We do not use your content to train AI models without your consent.

5. Subscriptions, Billing & Refunds

Paid plans and pay-as-you-go usage are billed through our third-party payment processor. Subscriptions renew automatically for the chosen period unless cancelled before renewal; you can cancel at any time, effective at the end of the current billing period. Fees are non-refundable except where required by mandatory law. We may change prices with reasonable advance notice.

6. No Warranty

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. We do not warrant that outputs will be accurate, complete, reliable, non-infringing, or fit for a particular purpose, or that the Service will be uninterrupted, secure, or error-free. AI models and features may change or be discontinued.

7. Limitation of Liability

To the maximum extent permitted by applicable law, mazdek shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising from or related to your use of (or inability to use) the Service or any AI output.

mazdek's total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) CHF 100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory Swiss law (including for intent or gross negligence, or non-waivable consumer rights).

8. Indemnification

To the extent permitted by law, you agree to defend and hold mazdek harmless from claims, damages, and costs (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms or of any law or third-party right.

9. Intellectual Property

The Service itself — including its software, models, design, trademarks, and content provided by mazdek — is owned by mazdek or its licensors and is protected by law. These Terms do not transfer any such rights to you beyond the limited right to use the Service.

10. Third-Party Services

The Service relies on third-party providers (for example, for payments, hosting, and AI processing). Your use may also be subject to their terms, and we are not responsible for third-party services we do not control.

11. Suspension & Termination

You may stop using the Service at any time. We may suspend or terminate access — with notice where reasonable — if you breach these Terms, create risk or legal exposure for us, or where required by law. On termination, your right to use the Service ends; sections that by their nature should survive (e.g. ownership, disclaimers, liability, indemnity, governing law) will survive. If we terminate your account for a breach of these Terms, any unused prepaid credits may be forfeited to the extent permitted by law.

12. Changes to These Terms

We may update these Terms as the Service and applicable law evolve. For material changes we will give reasonable notice (e.g. by email or in-product) at least 30 days before they take effect where practicable. Continued use after the effective date means you accept the updated Terms; if you do not agree, stop using the Service.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The courts at mazdek's registered seat in Switzerland have exclusive jurisdiction, subject to any mandatory jurisdiction or protections that apply to you as a consumer under the law of your country of residence.

14. General

If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and mazdek regarding the Service.
